Synopsis: Respondent Property Manager Barton managed property belonging to the Complainant’s brother. During the management of the property, Respondent Barton failed to account for and disclose fees paid by the tenant, and failed to deposit funds in the trust account within 3 days of receipt. Respondent Barton charged management fees to the Owner when no rent was collected and charged the Owner 16% on bills paid on the Owner’s behalf even when the funds belonged to the Owner. Respondent Barton also failed to keep proper records in accordance with Commission Rules.
